Under Florida law, a presumption of undue influence is created when certain factors are present in the changing of an estate plan, such as the presence of a beneficiary of assigning, the presence of the beneficiary at the discussion with the attorney regarding that estate plan. It also means that when a fiduciary, such as someone acting under a power of attorney or who holds another type of fiduciary relationship with an individual ends up being a beneficiary under a well, there is a presumption that can be rebutted of undue influence in procuring that inheritance.
