Nursing homes are required to keep records of the care they provide. There is a file kept on each resident. That resident’s file includes the medications they’re taking, how often they’re taking them, the kinds of care they’re provided, doctor visits and whether or not they eat as well as all medical records related to their care in that facility.

Nursing home residents are entitled to privacy. They’re entitled to privacy in their care, and their health care records, as well as their communication with others and their mail.

Am I allowed to keep all of my Social Security and pension if I am in a nursing home and Medicaid is paying for my care?

Individuals on Medicaid in a nursing home are required to pay what’s called a patient responsibility. The patient responsibility is their gross income minus their Medicare supplemental policy minus their personal needs allowance, which ranges from $35 to $100 a month depending on your state. All the rest of your income except these two deductions, or deductions for your community spouse’s support must be paid to the nursing home.

What is filial responsibility?

Filial responsibility refers to the obligation imposed by statute, in many states, holding family members liable for the costs of care and upkeep for an elderly or disabled loved one. These laws differ depending on which state you are in.  And some states, like Florida, do not have filial responsibility laws.
