You can give your agent under a power of attorney the authority to make medical decisions. This would be referred to as a medical power of attorney. This may be separate from your durable power of attorney for financial issues. In some states, your durable power of attorney can include both financial and medical.
Can I disinherit my spouse or my children?

It is extremely difficult to disinherit your spouse or minor children in the states, in the United States. All states have laws that allow a spouse to claim a certain share of the estate unless they have signed a prenuptial or postnuptial agreement. All states also include support mechanisms of the estate to ensure that minor childhood have support at least during the pendency of a probate, if not longer.
Can I be barred from Medicaid if I just moved into Florida?

You cannot be barred from accessing Medicaid if you have just moved to Florida. Residency requirements under Medicaid only require that you have entered the state. As long as you are medically eligible and financially eligible for Medicaid benefits you will qualify.
Can I add my daughter’s or son’s name to my bank account instead of having a power of attorney?

Adding a daughter or son’s name to a bank account as a joint owner, or signatory, does not replace a durable power of attorney. If you add your daughter or son’s name to a bank account all they can do is utilize that particular bank account. They cannot request information regarding the income coming into that account or information about the bills they may need to pay from that account.
