An estate plan usually includes a health care surrogate designation or other advanced directive, a durable power of attorney, often times a trust, and ultimately a last will and testament. These documents can be used to prevent a guardianship in a variety of ways. First of all, the durable power of attorney allows someone to make financial and legal decisions for you when you become incapacitated. The health care advanced directive allows someone to manage your health care when you’re not able to do so. A trust can ultimately allow someone to manage your property in that trust and disperse it when you die.
